Child Maintenance Law In Pakistan
Understand the Legal Framework
Pakistan does not legally recognize adoption as per Islamic law; instead, prospective adoptive parents become guardians of the child through court. The child’s name and identity (including surname) generally remain unchanged. The process is overseen by the Family Court or Guardian Court.
2. Eligibility Criteria
The guardian must be a Muslim Pakistani citizen (though non-Muslims can apply in some cases).
The guardian should be financially stable, mentally sound, and capable of taking care of the child.
Married couples are usually preferred.
Single women can apply, but single men typically cannot adopt girls.
3. Choosing an Orphanage or Welfare Organization
You must contact a registered organization such as:
Edhi Foundation
SOS Children’s Village
Saylani WelfareThese organizations conduct initial screening and often recommend potential guardians for court proceedings.
4. Apply for Guardianship in Court
After selecting a child, the next step is to file a petition for guardianship under the Guardians and Wards Act 1890 in the relevant Guardian Court. This involves:
Submitting identification documents
Providing financial and character references
Attaching documents from the welfare organization
Filing an affidavit of intent.
